This indenture made this twenty first day of February in the year of our Lord one thousand seven hundred and ninety two between James Jennings of the County of Loudoun and Commonwealth of Virginia, farmer of the one part, and John Foster of the town of Alexandria County of Fairfax and Commonwealth aforesaid of the other part. Whereas the said James Jennings is the lawful owner of a negro man slave named Elijah which negro man slave after completing the service of five years he is desirous shall be free. Now this indenture witnesseth that the said James Jennings for and in consideration of the sum of thirty five pounds current money of Virginia to him in hand paid by the said John Foster the receipt whereof is hereby acknowledged hath granted, bargained, and sold, aliened and confirmed and by these presents doth grant, bargain, and sell, alien & confirm unto him the said John Foster his heirs and assigns the said negro man slave named Elijah for and during the term of five years from hence next ensuing to have and to hold the said negro man slave named Elijah to the said John Foster, his heirs, and assigns to his and their only proper use and behoof for that time, and the said James Jennings for himself, his heirs, Exors and Admors doth covenant, grant, and agree to & with the said John Foster, his heirs, Executors, Admors and assigns that in case the said negro man slave die before expiration of five years from hence next ensuing that then he the said James Jennings, his heirs, Executors, Admors or any other person or persons respectively him shall and will well and truly refund to the said John Foster, his heirs, Exors, Admors or assigns such a sum of money as may be for that time in proportion to thirty five pounds for the said five years and the said James Jennings as well for and in consideration of the former faithful services of him the said negro man slave as, for, and in consideration of the sum of thirty five current money as aforesaid paid by the said John Foster doth hereby at the end and expiration of the said five years fully, freely, and absolutely emancipate and set free the said negro man slave and so to remain the rest of his life. And lastly, the said James Jennings the said negro man slave unto the said John Foster for the term of five years aforesaid and to his heirs and assigns doth hereby warrant & defend against the claim and demand of him the said James Jennings, his heirs, and assigns and of all and every other person or persons whatsoever. In witness whereof the said James Jennings hath hereunto set his hand and seal the day month and year aforesaid.
