Know all men by these presents that me Elijah Sawyer and Maria wife of said Elijah Sawyer, Obediah Henderson and Casey wife of said Obediah Henderson, Andrew Moore, and Polly wife of said Andrew Moore, Richard Bundy and Mary wife of said Richard Bundy, Jenny Bundy and Adam Bundy, the said Maria alias Maria Bundy, Caty alias Caty Bundy, Polly alias Polly Bundy, Jenny alias Jenny Bundy, Adam alias Adam Bundy, and Richard alias Richard Bundy late of the County of Essex and State of Virginia and late the slave of Samuel Kendall deceased of the County of Essex and State aforesaid and left free by his last will and testament, the said Maria, Caty, Polly, Jenny, Adam & Richard which will more fully appear by reference being had to the record of said will, which was ordered to be recorded by the Court of Essex County in the State of Virginia on the 15th day of January A.D. 1821. We do hereby constitute and appoint Isaac Harris of Jefferson County and State of Ohio our attorney for us, and in our names and for our use to convey in fee simple by deed of general warranty for such a price upon such terms and to such a person and a persons as he shall think fit, the following premises situated in the County of Essex and State of Virginia, which is described in said Samuel Kendall’s will to said heirs as the Mount Landing Farm. If said Mount Landing Farm has been sold according to law, we do hereby authorize our said attorney to lender and deed of conveyance to the owner thereof by him paying to him our said attorney the purchase money with all interest therein, and to fill up all blanks or many any alteration necessary in the deed we send by him, and also to collect by suit or otherwise from any person or persons, their heirs, executors or administrators that of purchased the said Mount Landing Farm before mentioned or holds said farm by the right of will. We do hereby authorize our said attorney to collect by suit or otherwise all monies in anywise coming to us from the executor Nathaniel J. Mothershead or his heirs, he the said Nathaniel J. Mothershead being the executor of the estate of Samuel Kendall dec’d or the administrator de bonis non if any was appointed by the court to seal the estate of Samuel Kendall dec’d. We furthermore empower our attorney to examine all records made of returns made out by the executor Nathaniel J. Mothershead or any other person in respect, to settlement of said estate of Samuel Kendall dec’d and correct all errors if any made in anywise in the settlement, with the court of Essex County of Virginia, in settling said estate. We also empower him our said attorney to use all honorable means to find out the condition and situation of the two colored men that was left by Samuel Kendall dec’d on the Mount Landing Farm, and it’s our wish if it is in the power of said attorney to have them set free if they are held in bondage if the law will admit it. And we do hereby further authorize our said attorney to collect all monies due in owing to us from any person or persons in the State of Virginia and especially to collect all money due us from the estate of Samuel Kendall deceased late of the County of Essex, State of Virginia.
Our said attorney is hereby authorized for all monies paid to him for our use to receipt for by pleas under seal or otherwise. Whatsoever our said attorney shall lawfully do in the premises do hereby confirm the same as if we were ourselves personally present, and did the same. In witness whereof we have thereunto set our hands and seals this twenty third day of March in the year of our Lord eighteen hundred forty six.

We Isaac Harris and Joseph Kithcart, Justices of the Peace in the County aforesaid in the State of Ohio, do hereby certify that Elijah Sawyer, Obediah Henderson, Andrew Moore, Jenny Bundy, Adam Bundy, and Richard Bundh parties to a certain power of attorney bearing date on the 23rd day of March 1846 and hereunto annexed personally appeared before us in our county aforesaid and acknowledged the same to be their act and deed, and desired us to certify the said acknowledgement to the Clerk of the Court in the County of Essex in the State of Virginia in order that the said power of attorney may be recorded if necessary. Given under our hands and seals this 23rd day of March AD 1846.

We Isaac Harris & Jo’s Kithcart, Justices of the Peace in the County aforesaid in the State of Ohio do hereby certify that Maria Sawyer wife of Elijah Sawyer, and Caty Henderson wife of Obediah Henderson, Polly Moore wife of Andrew Moore, and Mary Bundy wife of Richard Bundy parties to a certain power of attorney bearing date on the 23rd day of March 1846, and herein annexed, personally appeared before us in our county aforesaid, and being separately examined privately and absent from their husbands, and having the within instrument fully explained to them, the said Maria Sawyer, Caty Henderson, Polly Moore & Mary Bundy acknowledged the same to be their act and deed, and declared that they had willingly signed and sealed and delivered the same and that they wished not to retract it.

I James Johnston, Clerk of the Court of Common Please within and for said County of Jefferson do hereby certify that Isaac Harris and Joseph Kithcart Esq, before whom the foregoing power of attorney was acknowledged, were on the day of the date of said acknowledgment and still are acting Justices of the Peace, within and for said County of Jefferson, duly elected, commissioned and qualified, & to whose acts as such, full faith, and credit are due, and out to be given in any Judicial Court in the State of Ohio or elsewhere.
In testimony whereof I have hereunto set my signature and affixed the seal of one said Court of Common Pleas at the Clerk’s Office in Steubenville this 27th day of March AD 1846.
