Text of Freedom Document
I Robert S Bailey of Surry County being in good health and of sound mind and memory do make and ordain this to be my last Will and Testament in manner and form as followeth to Wit_
1st I give and bequeath to my sister Jenny Bailey a legacy of ten dollars_
2nd Being persuaded that freedom is the right of all mankind it is my Will and desire that all and every one of my Negroes should be free to wit, Martin Patrici, Eszekiel William, Charlotte Marinda and Matilda_
all those that are under Age should serve there mother untill such time they arrive to a lawfull age_
3_ I give and bequeath to my Charlotte my lot and houses my Orchard and Orchard ground, likewise twenty five Acres of my best woodland the residue equally to be divided between Patrick Eszekial and William all the children of Charlottes_
4th I give and bequeath unto my Negroe Charlotte my Bbl and ½ Still my grate Iron pot my looking glass [illegible] cows and Calves of the first choice_
5th The residue of my estate to be sold and after paying my just debts and funeral expenses the residue to be equally divided between Eszekiel and William if any_
6th I constetue[?] and appoint John Watkins of Sussex County to be my whole and sole Executor of this my last Will and Testament I do here by utterly disallow all former Wills and bequeaths by me made. In Witness whereof I have hereunto set my hand and affixed my seal this seventeenth day of April 1822_

At a Court held for Surry County, Feby 24th 1823
The within last Will and Testament of Robert S. Bailey deceased was this day presented in Court, the same was proved by the oath of Arther Holleman a subscribing witness thereto, and was by the Court ordered to be recorded as far as respects personal estates John Watkins the Executor named in the said Will refused to take on him the burthen [?] of the execution thereof on his motion his said refusal is entered of record. On the motion of James A Bailey who made oath and gave Bond with William E. Bailey, Richard H.L. Bailey, Arthur Holleman and John Watkins his securities, in the sum of Five Thousand Dollars, conditioned as the Law directs. Letters of Administration with the said Will annexed is granted him_
