In the name of God Amen. I Micail Malone of Albemarle Parish in Sussex County being of disposing mind and memory thanks to Almighty God for the same do make and ordain this my last will and testament in manner and form following.
First I recommend my soul to God who gave it me and my body to the Earth to be decently buried at the discretion of my Executors hereafter named and do touching such worldly goods as it hath pleased God to help me with I dispose thereof in the following manner viz.
Imp I give and bequeath unto my loving wife Anne Malone all the estate of what kind soever that hath or shall come to me by intermarrying with her with all the rents, hires, and increase thereof, also thirty barrels of corn out of the ensuing crops to her and her heirs forever. I also lend my said wife the use of all the houses on the plantation whereon I now live, with all the plantation and do much of the wood land as will be sufficient to support her family during her widowhood.
Item I give and bequeath to my daughter Lucy Gary (twelve months after my decease) seventy five pounds lawful money of Virginia to her and her heirs forever.
Item My will and desire is that my executors retain in their hand thirty pounds lawful money of Virginia and put it to interest until my grandson Right Irvin Bonner (son of John Bonner) come to the age of twenty one years at which period I give and do bequeath to my said grandson Right Irvin Bonner the said thirty pounds & the interest thereof to that time to him and his heirs forever.
Item I give and bequeath to my son John Pettway Malone one tract of land on Stoney Creek in Dinwiddie County supposed to contain four hundred and thirty seven acres (be the same more or less) it being all the land I own in that county to him and his heirs forever. I also give to my said son my sorrel mare and one new saddle and bridle and one negro boy James until the said James comes to the age of twenty one years at which time I hereby set the said James free to act and do for himself as other free people. I also give my said son one [illegible] and my will is that my said son should have his estate at nineteen years of age.
Item I give and bequeath to my four daughters Polley Malone, France Malone, Rebekkah Malone, and Patsey Malone the profits of all my land in Sussex County (exempt what I have left my wife the use of) until my daughter Rebekkah Malone arrives to the age of twenty one years at which period I give and do bequeath to my said four daughters (or such of them as shall be then living) all the said land to be equally divided among them and at the marriage or death of my wife, all the land I have left my wife the use of to be equally divided amongst them all which I give to them and their heirs forever. I give and bequeath to my four daughters Polley, Frances, Rebekkah and Patsey three negroes name by Joan, Patt and Sukey Ward until they arrive to the age of twenty one years at which time I have set the two first free by [illegible] and when the last namely Sukey Ward comes to the age of twenty one years I hereby set her free to do for herself as other free people.
Item I give and bequeath to my six children Lucy, John Pettway Malone, Polley, Francis, Rebekkah, and Patsey all the residue of my estate of what kind ever to be equally divided amongst them to them and their heirs forever.
Item and lastly I constitute and appoint my brother William Malone, my son John Pettway Malone, William Pettway, brother of my deceased wife Stith Parham and Robert Jones whole and sole Executors of this my last will and testament revoking all other wills and declaring this and this only to be my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this sixth day of March Anno Dom one thousand seven hundred and ninety seven.

At a court held for Sussex County the 1st day of February 1798 the last will and testament of Michail Malone deceased was exhibited in court by William Malone the Executor therein named the same was proved by the oaths of the witnesses thereto and ordered to be recorded and on the motion of said executor who made oath and full bond and security agreeably to law certificate is granted him for obtaining a probate thereof in due form.
