The last will and testament of Elizabeth N. Carter Deceased
I Elizabeth N. Carter of the County of Clarke & State of Virginia being of sound and disposing mind and memory do hereby make my last will and testament in manner and form following, hereby revoking all other or former wills by me heretofore made.
First. I direct my executor hereinafter named to pay all my just debts & funeral charges.
2nd I give and devise all the rest and residue of my estate, real, personal, and mixed of which I may die seized and possessed to my sons John B. Carter and Jaculin H. Carter, except a negro girl Nancy which it is my will and I do hereby manumit and set free, and I do hereby charge my Executor to take as much of my estate as may be necessary to pay all expense in sending her off to some free state, and it is also my will that my sisters Nancy Allen and Jane Foster shall have all my wearing apparel. My estate as above mentioned to be equally divided between my two sons John B. and Jaculin W. Carter.
Lastly I constitute and appoint my friend Thomas E. Gold Executor of this my last will and testament. In witness of the foregoing premises I have hereto set my hand and seal this 28th day of April 1854.

In the County Court June Term 1866
At a court held for the said County, on Monday the 11th day of June 1866. The foregoing last will and testament of Elizabeth N. Carter deceased was proved by the oath of John Gold, one of the subscribing witnesses, who testified that the testatrix published and declared the same to be her last will and testament in his presence and in the presence of James A. Allen, the other subscribing witness thereto, that they subscribed the same as witnesses in the presence of the testatrix and of each other and at her request, and that the other subscribing witness resides out of the State of Virginia, and that he believes the said testatrix was of perfect sense and memory at the time of publishing the said will as aforesaid, and thereupon it is ordered that the said will be recorded. And on the same day on motion of Thomas E. Gold, the Executor therein named, who made oath as the law requires and with F. J. Kerfoot, his security entered into and acknowledged a bond in the penalty of $5,000.00 with condition according to law, certificate is granted him for obtaining probate of said will and letters testamentary in due form.

appears that this will was not admitted to record until 1866, making the assumption that the woman Nancy would have already been free through emancipation. Further research needed to confirm this, as the will was written much earlier, in 1854.
