Text of Freedom Document

I David Trisler of Clarke Co in the State of Virginia being of advanced age & feeble health but by the blessing of God of sound mind & memory do make & publish this my last will & testament.
1st I appoint my trusty friend Washington Ferguson & Thomas Humphreys my Executors.
2nd I desire that my funeral expenses & all just debts be paid & settled as soon as possible after my decease.
3rd I give to my said Executors full power to sell all my real & personal estate on such terms as to them shall seem most advantageous for my heirs.
4th I desire that my servant Rufus shall have the privilege of selecting his house as he has been heretofore accustomed to do if he shall pay or cause to be paid or secure to the satisfaction of my said Executors the sum of five hundred dollars & give all necessary securities that he shall not in any way become a charge upon my estate I desire that he shall be set free by my said executors.
5th I desire that my estate after the settlement of all my debts & sale of my property real & personal & collection of the proceeds of such sales be divided among my four sisters & their children according to the laws of inheritance of the State of Virginia.

Codicil
In case any one or more of my sisters should fail to claim either in person or by legal child or issue the portion or portions bequeathed by the foregoing will for the term of five years after my decease I desire that such portion or portions be divided among those other sisters who may be living & the issue of such as may be dead & who may have established their title to inheritance under this will. And on reflection & in consideration of my servant Rufus faithful service I desire my Executors to redirect fifty dollars of the five hundred required in this will as a condition of his freedom.

At a court held for the County aforesaid on Monday the 23rd day of January 1854.
The last will of David Trisler dec’d was returned to court and proved by the oaths of Geo. Orear and Jno. C. Underwood the subscribing witnesses & codicil proved by the oaths of Jno C. Underwood & Allen S. Payer the subscribing witnesses thereto and ordered to be recorded.
