Text of Freedom Document

In the name of God Amen, I John C. Hill of Matoaca in the county of Chesterfield, do make and declare the following instrument in writing, to be my last will and testament, hereby revoking all other wills by me at any time heretofore made.
In the first place I direct that all my just debts and funeral expenses be paid as soon as may be conveniently after my decease, by my executor herein after named.
Secondly, I direct that the dividends of the stocks which I now hold in the Matoaca and Merchants manufacturing companies be paid to my sister Rebecca P. Mumford wife of Thomas Mumford during her life for her separate use, and at her death, the said stocks to belong to her surviving children, equally to be divided between them, and if any of the children of my said sister Rebecca P. Mumford shall depart this life during the life time of their mother, those children’s children to have the same provision out of the said stocks, that their parent or parents would have had, had they been alive at the death of the said Rebecca P. Mumford; and I direct my executor above referred to, shall hold the said stocks during the lifetime of the said Rebecca P. Mumford, but nevertheless, as trustee for the said Rebecca P. Mumford, and shall pay her the dividends thereon as before directed.
Thirdly, I do hereby liberate and emancipate my negro man slave Francis, now hired to Mr. Atkinson of Petersburg, the said negro Francis to receive all the hires and money now due and which may become due to me from the said Mr. Atkinson for his heirs as aforesaid, my executor however to receive the said hire and money from the said Atkinson, but nevertheless, for the use of the said negro Francis.
Fourthly, I hereby give and devise to my relative Sally B. Rison, in fee simple, a tract of land in Amelia of about one hundred and forty acres, being the lot of land which fell to my brother in the division of my father’s estate, and which I purchased from him, and I also give to the said Sally B. Rison the sum of two hundred dollars in money.
Fifthly, I hereby give and bequeath to James R. Eggleston the sum of one hundred dollars, also to my niece Willie Ann Cindiffe the sum of one hundred dollars, also to my brother James P. Hill the sum of one hundred dollars; also to my brother Edwin C. Hill the sum of fifty dollars.
Sixthly, I give and bequeath to my executor herein after named the sum of five hundred dollars to be expended on the education of my nephew Richard Mumford, and for his use and benefit.
Seventhly, I give and bequeath to my executor aforesaid, my [illegible] in the paper mill building at Matoaca to be applied by my said executor towards building a Presbyterian church at or near to Matoaca.
Eighthly, I desire that my said executor shall pay to the store at Matoaca the amount due the said store by Mrs. Polly Farley, and make no charge against the said Mrs. Farley.
Ninthly, I desire that whatever balance may be due me by my brother in law Thomas Mumford, be given up to him by my executor aforesaid.
Tenthly, I do hereby give, devise and bequeath to my nephew Edward John Mumford, all the rest and residue of my estate both real and personal, in absolute fee simple which has not herein before, by me, been specifically devised or bequeathed, and I do hereby make and appoint the said Edward John Mumford the executor of this my said last will and testament, and do desire that the court may not require him to give security or to render an appraisement of my estate as such executor.
In witness whereof I the said John C. Hill have hereunto set my hand and seal this twenty third day of May in the year of our Lord one thousand eight hundred and thirty seven.

In Chesterfield County Court, June 12th 1837. The last will and testament of John C. Hill deceased was proved by the oath of Richard Lee Jones and T.G. Smith subscribing witnesses and ordered to be recorded.
On the motion of Edward John Mumford an executor in the said will named, who made oath thereto, and entered into bond, without security, none being required, in the penalty of ten thousand dollars, conditioned as the law directs, a certificate is granted him for obtaining probate thereof in due form.
