In the name of God Amen. I William Kerr at this time an inhabitant of the town of Manchester of State of Virginia, do make this my last will and testament in manner and form following to wit: I hereby direct that all my estate both real and personal be sold by my executors herein after named and that the proceeds arising from such sale be proportioned according to the following mode of devise.
First, that my brother John Kere a native of that part of the Island of Great Britan called Scotland shall receive from the proceeds of said sale the sum of fifteen hundred pounds, sterling money.
Secondly, I do hereby devise to my mother Mrs. Jean Kerr, to my brother Hugh Kerr, to my sisters Mary, Janet, Jean, Agnes, Margarett, Elizabeth, and Ann Kerr alternatives of the said part of Island of Great Britain called Scotland, an equal proportion share and share a like of the remainder of the proceeds arising from the sale of my said property, but it is expressly understood that no legatee heretofore mentioned shall be entitled to priority in print of time for the receipt of his legacy, but shall receive their respective proportions according to the funds in the hands of my executors hereafter named. It is furthermore my desire that a faithful slave belonging to me and called by the name of Lucy should be emancipated by my executors provided no act of the Virginia Assembly should prevent such emancipation, or should such act exist at the time of my death and be afterwards repealed (giving to owners of slaves the power and right of emancipation) I desire my executors to emancipate and manumit the said slave Lucy as soon as the existing law will permit. And it is my desire that the said slave Lucy receive from my estate five hundred dollars for her support and maintenance. It is my positive will and desire that every fair demand or debt existing against me or hereafter property to be demanded should be faithfully discharged, and for the purpose of carrying this my last will and testament into effect I do hereby nominate and appoint my trusty friends Thomas Treadway, Alexander Kerr, John Gilchrist, and Robert Graham executors this will. In testimony whereof I have hereto subscribed my name and annexed my seal this twenty sixth day of August in the year of our Lord one thousand eighteen.

In Chesterfield County Court April the 13th 1818
This testament and last will of William Kerr deceased was proven by the oath of James W. Winfree a subscribing witness and the hand writing of Archibald McRae and Edward D. Diggs two other subscribing witnesses (who are now dead) was proven by the oath of the said James W. Winfree, whereupon the same was ordered to be recorded. And on the motion of Robert Graham an executor therein named who took the oath prescribed by law and entered into bond with security conditioned as the law directs, a certificate is granted him for obtaining probate thereon in due form.
