This deed made this eighth day of December 1856 between Clara Phelps of the one part and Daniel W Capell of the other part all of Wythe County Virginia. Whereas the said Clara Phelps being desirous to emancipate her slave John which deed of emancipation is to take effect at the death of said Clara Phelps, unless she otherwise in writing direct, and for the further sum of one dollar in hand paid by said Daniel W Capell the said Clara doth hereby convey unto the said Daniel W Capell a negro man slave named John aged about forty one years, in trust for the use and benefit of said Clara Phelps as long as she may live, and at her death the said trustee is authorized and directed to emancipate the said slave John by deed or other will and if said Clara Phelps should determine to emancipate the said slave at any time previous to her death, she hereby reserves the power to do so, by writing to that effect duly signed, acknowledged and recorded. And in the event of the death of said trustee, the county court of Wythe is hereby authorized to appoint a successor. The said Daniel W Capell hereby undertakes faithfully to perform the trust hereby reposed in him.

Virginia: At a court continued and held for Wythe County at the courthouse the 9th December 1856.
This deed from Clara Phelps to Daniel W Capell trustee was presented in court and with the certificate of acknowledgment annexed ordered to be recorded.
