I Nancy Crockett of the County of Wythe and State of Virginia: having arrived at aged years, and attended with bodily infirmities, but of sound mind and disposing memory & being desirous of disposing of all such worldly estate as it hath pleased God to bless me with, I do hereby make this my last will and testament in manner and form following viz. 1st I give my son Ephraim D. Crockett the plantation whereon he now resides, also all the cattle, horses, hogs, household and kitchen furniture and farming utensils, now in his possession belonging to me.
2nd I give to my daughter Catharine Sayers, my negro woman Patsey and all of her increase except Miriam and her children: also Joanna and all her children, I give to my daughter Catharine Sayers.
4th I give to my son Hiram C. Crockett during his natural life, my homestead plantation and after the decease of my said son Hiram C. Crockett I give the said homestead plantation to my two grand sons William Crockett and John Crockett.
5th I give also to my grandson John Crockett a negro boy named Lazarus and a negro girl named Mary.
6th I give to my daughter Lucy Burnes five hundred and fifty dollars, out of which said five hundred and fifty dollars I wish the note held by my son in law Thomas Burnes to be paid.
7th I give to my granddaughter, Catharine R Burnes four hundred and fifty dollars.
8th I give to my grandson John Crockett and his heirs my negro boy John.
9th I give to my granddaughter Nancy Hill my sorrel mare known by the name of Patts.
10th I give to my granddaughter Nancy Sayers my sorrel mare known by the name of Customary.
11th I order in my will that my slaves old Jim, Peggy, Jack, Bob, young Jim, Agnes, Miriam and all her children have their freedom at my decease.
12th I furthermore order in my will that my Executors out of the proceeds of the sale of my personal property, retain & put on interest the sum of forty dollars which sum with its interest, to be appropriated to the removal of my said negro woman Miriam and her children, old Jim and Peggy to a free state, after my decease.
13th I furthermore direct in my will, that all my personal property not mentioned and disposed of in my will be sold and the proceeds to be applied to the payment of my just debts and funeral expenses. And all the balance of money arising from said sale be equally divided between my two sons Ephraim D. Crockett and Hiram C. Crockett.
14th and last I appoint my son in law Henry D. Sayers and my friend Charles L. Fox my executors to carry in to effect this my last will and testament hereby revoking all other wills by me heretofore made.
In testimony whereof I have hereto signed my name and affixed my seal this thirtieth day December eighteen hundred and fifty four.

At a Circuit Court held for Wythe County at the court house on Friday the 3rd day of October 1856. The above writing purporting to be the last will and testament of Nancy Crockett dec’d was again produced and the court having maturely considered all the testimony and being sufficiently advised what judgment to render in the premises, it is considered by the court that said writing be admitted to record as the last will and testament of Nancy Crockett dec’d. Therefore it is considered by the court that Ephraim D. Crockett who offered the writing for probate recover against Henry D. Sayers & Ephraim M. Garrick guardian of the infant heirs of Paul C and Mary D Hill his certs by him about this motion in that behalf expended. H.S. Mathews is allowed sixteen dollars for writing testimony on motion to admit the will of Nancy Crockett dec’d to probate to be paid by the executor of said Nancy Crockett and taxed in the bill of certs.

And at a circuit court continued & held for said county at the courthouse on Saturday the 4th day of October 1856.
Henry D. Sayers and Charles L Fox Executors appointed by the last will and testament of Nancy Crockett dec’d having by a writing under their hands, refused to take upon themselves the burden of the execution thereof, on motion of M.B. Tate, who took the oath required by law and together with Charles C. Tate and William Gibboney his securities entered into and acknowledged a bond in the penalty of two thousand dollars conditioned as the law directs, certificate is granted him for obtaining letters of administration on the estate of Nancy Crockett dec’d with the said will annexed in due form.
