In the name of God Amen. I William Finley Senr of the County of Wythe and State of Virginia being sick and weak in body but of sound mind and disposing memory (for which I thank god), of calling to mind the uncertainty of human life, and being desirous to dispose of all such worldly estate as it hath pleased god to bless me with, I give and bequeath the same in manner following that is to say first, it is my desire that my lands be divided in four parts, as nearly equal as conveniency will admit of, and then be divided as follows, first, that part, which adjoins, Gasper Rader, and extending from his line, to include the dwelling out houses and apple orchard. I give and bequeath to my wife Judith Finley during her life or widowhood at her decease or marriage to return to my daughter Mary Ammy, and the child with which my wife is now pregnant, further it is my will that my wife shall have all my household and kitchen furniture, together with all my farming utensils, my wagon and stock of iron and steel on hand, also my negro woman slave named Hager to belong to my wife until my daughter Mary Ammy is married or comes to the age of eighteen years. Then it is my will that the said Hager be set free. It is my desire that my negro man named Ned be yearly hired out, and the money arising thereby be applied to the benefit of my wife and my children by her during her life or widowhood, and at her decease or marriage then the said Ned to be equal, between my children by her, also I give and bequeath to my wife four head of milk cows, such as she will choose, also four head of young cattle, also my sorrel horse (Joe), my bay horse (Boomer), also a black mare and an iron gray mare and ten sheep of her choice, also eight hundred pounds of pork of the hogs now fattening, and the half of my out hogs. The second part of land which s to be laid off adjoining Frederick Leonard, in such a manner as to include a good steaming spring, I give and bequeath to my son Esau Finley and his heirs forever, also a negro boy named Sampson also a bay colt, known by his Colt, and such of the cows, hogs and sheep as is called or known to be his, also my wheel wright and [illegible] tools. The other two parts of land which lies between the first mentioned parts, I give and bequeath to my daughter Mary Ammy and the child unborn to be equal between them, also I give and bequeath to my daughter Mary Ammy a negro boy named Reubin and a negro boy named Henry to the child unborn. I give and bequeath to my son William Finley my blacksmith tools, I also give and bequeath to my daughter Rhoda Finley one sorrel filly, also I give and bequeath to my daughter Margaret Finley one sorrel mare. It is my further will that as much of the grain on hand as will be necessary for the support of the family to the ensuing harvest be reserved for that purpose, and the balance of the grain port, hogs, cows and sheep not before bequeathed be sold by my executors (hereafter to be named) and the money arising from the sale together with the debts due to me be applied to the discharge of my lawful debts, and the balance if any I direct to be paid to my son John Pettus Finley, and lastly I do hereby constitute and appoint my wife Judith Finley Executrix and my friends William Finley, Samuel Crocketts and Robert Adams Executors of this my last will and testament hereby revoking all other or former wills or testaments by one heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this fifteenth day of December in the year of our Lord one thousand eight hundred and one.

At a court held for Wythe County the 9th day of February 1802
This last will and testament of William Finley dec’d was proved by the oaths of the witnesses thereto subscribed and is ordered to be recorded, and Robert Adams one of the Executors named in the said will relinquished his right of Executorship to the same.
