William Kimbrough of the County of Louisa and state of Virginia, do hereby make my last will and testament in manner and form following that is to say. 1st I desire that all my just debts and funeral expenses be paid out of the perishable part of my estate.
2nd It is my will and desire that my woman slave, Anne Cosby, and her four children by name as follows: Hugh M. Cosby, William
A. Cosby, Josephine Cosby and Robert N. Cosby to all intents and purposes from the claim or claims of any person or persons now and forever.
3rd I give to Anne Cosby's four children named above: Hugh M. Cosby, William A. Cosby and Josephine Cosby and Robert N. Cosby all and every part of my estate that I may die possessed of both real and personal after paying my just debts and funeral expenses and my executor what I shall leave him for his commission and trouble seeing that this my will is carried into effect to them and their heirs forever to be equally divided among them. Their mother is to have a support out of what I leave to her children named above during her natural life.
4th it is my will and desire that my executor whom I shall hereafter-name remove my woman slave, Anne Cosby, named above and her four children to some free state if they are not allowed to remain in this Commonwealth and be free and there have them schooled if it can be done conveniently.
5th It is my will and desire if my woman slave, Anne Cosby, and her four children named above should not be allowed to remain in this Commonwealth that my executor sell all my estate that I may die possessed of both real and personal to the highest bidder except my woman slave, Anne Cosby, and her four children named above and what my executors think it would be best for them to take along with them if they have to leave this Commonwealth and after selling divide the proceeds thereof among Anne Cosby's four children above named and stated above.
6th it is my will and desire that my friend, Jonathan T. Cowherd, see that this my last will and testament is carried into effect. I therefore constitute and appoint my friend, Jonathan T. Cowherd, executor of this my last will and testament and that five hundred dollars out of my estate provided he will see this my last will and testament carried in to effect if in his power for his services. I hereby revoke all other or former wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this third day of November eighteen hundred and forty five. [Sig.] William Kimbrough. wit. Wm. Garrett, Thos. H. Codicil to the within will. I hereby confirm the said will and declare the same to be my true last will and testament and if it is against the laws of the state of Virginia for the within named Anne Cosby and her said children at the time of their emancipation to hold or take by bequest other slaves now owned by me I desire my executors to sell my said other slaves and divide the proceeds of sale between the said Anne Cosby and her children or between such of them as shall be living at the time of my death. In witness whereof I have hereunto set my hand and affixed my seal this twenty eight day of March 1850. [Sig.] W. Kimbrough. Wit. Claudius Dickinson, Causus M. Carpenter, Addison T. Carter.
Codicil 2nd to the foregoing will. I William Kimbrough of the County of Louisa do make this 2nd codicil to my will. I hereby declare my intention and will to be that my slaves, Anne Cosby, and her four children, Hugh M., William A., Josephine and Robert N., together with the future increase of them or any of them after the date of this codicil shall be forever emancipated and set free and I do hereby accordingly emancipate them and set them free and direct they shall be removed to and settled in such free state or colony as they my executor may think best, either by my executor in person or such agent or agents as he may select.
And I hereby further direct that my said executor shall, as soon after my death as may be convenient, sell all my estate both real and personal excepting of course the slaves hereby emancipated and after the payment of all my just debts and legacy of five hundred dollars which I have given him in lieu of commissions and all expenses of executing this will shall divide the residue of the proceeds of sale together with all the rest and residue of my estate of every description whatsoever between the said Ann Cosby and her four children or such of them as may be living at the time of my death, share and share alike, that is to say one share to the said Anne Cosby and one to each of her said children or if the said Anne Cosby or any of her children be dead at the time of my death the whole to the survivors to be in like manner divided among them the share or portion hereby given to the said Ann Cosby being in lieu of the support directed to be given by the 3rd clause of the will.
And I further direct that my executor shall in addition to the legacy of $500 which he is to take in lieu of commissions allowing all and in addition to all other proper expenses and charges of administration be allowed all reasonable charges and expenses of himself and such agent or agents as may be employed by him in removing the Slaves hereby emancipated from this state and settling them comfortably in some free state or colony and also all other reasonable expenses which may be incurred in or about the removal and settlement of said slaves or any of them I hereby ratify and confirm my said will and the first codicil thereto except so far as they may be modified by this codicil which I desire strictly to be carried into effect. 7 September 1850.
