I Richard Sandidge of County of Louisa state of Virginia do make and ordain the following my last will and testament.
Item it is my will and desire that my executors hereafter named do pay all my just debts.
Item I emancipate and set free Louisa, Huldah, Eliza, Pamelia, Milton, Dabney and old Nelly also their present increase Susan, Westley, George, Andrew, Caroline and Sarah and their future increase. Their freedom to take effect at the death.
Item I desire my afternamed executors to sell the whole of my perishable estate and the residue of my slaves not emancipated as above upon a credit of twelve months.
Item I give and bequeath all my land to Louisa, Huldah, Eliza Pamella, Melton,
Dabney and Nelly to be equally divided among them at my death but in case of the death of either of them, then in that case the portion of the one so dying to become the property of his or her heirs if any and in case they leave no offspring to be equally divided among their surviving brothers and sisters. I give also the whole of the proceeds arising from the sales of the residue of my slaves directed to be sold and the proceeds arising from the sale of my perishable estate to Louisa, Huldah, Eliza, Pamelia, Melton, Dabney and Nelly on the same conditions on which my lands are given.
Item I give to Louisa, Huldah, Eliza, Pamelia, Melton and Dabney all monies that may be due me at my death by bonds, open accounts, mortgages &c.
I earnestly pray the legislature of my native state to suffer my slaves Louisa, Huldah, Eliza Pamelia, Melton, Dabney and Nelly their present and future increase to remain in Virginia to enjoy the property herein bequeathed to them and I beseech the legislature to grant me this last request in consideration of my Revolutionary services under Washington, Lafayette, Gates &c during a period of seven years. Should the legislature of Virginia however refuse to permit the above emancipated slaves to remain within this Commonwealth, then and in that case, it is my desire that the lands bequeathed to them to be sold by my executor and the proceeds thereof together with any portion of the proceeds arising from the sale of the residue of my slaves and perishable property which my executors deem proper to be laid out in lands which they may select which lands when so purchased to be equally divided among my slaves emancipated above in the same manner in which I have directed my lands in Virginia to be divided. I wish my executors to exercise a sound discretion on the propriety of selling my lands on a credit or for cash accordingly.
Lastly I constitute and appoint my friends, Edmund Pendleton and Jos. W, Pendleton, my executors to carry this my last will and testament to effect. Given under my hand and seal this 7th day of January in the year of our Lord, one thousand eight hundred and twenty nine. [Sig.] Richd. Sandidge wit. Miletus B. Harris, Samuel Harris, Cyrus (x) Harris. I do make and constitute the following as a codicil to the foregoing will. It is my will and desire that my before named Exors. Out of the proceeds of my perishable and personal estate pay, so soon as the same can be collected, to my nephew, Griffith Dickinson, one thousand dollars, and to my nephew, Charles Dickinson, one thousand dollars out of the proceeds of my personal and perishable estate above directed to be sold. I also give to my nephews, Griffith Dickenson and Chas. Dickenson, a Negro fellow (now in Kentucky in the possession of James Clarkson) named Tom to be equally divided between them I wish all the provisions made in my will to be carried into effect (as is there directed) except so far as I have altered the same in this my codicil. I Richard Sandidge do make and ordain the following second codicil to my will now in in the possession of Edmund Pendleton. It is my will and desire that my executors at my death deliver to my sister, Nancy Dickenson, my negro woman, Fanny, and her child (which Negro woman and child I had directed to be sold in my will), my said sister, Nancy, to hold said Negro woman, Fanny and child and their increase, in fee simple with the power of willing them at her death to whom she pleases. It is my desires that my will be carried into effect fully except so far as respects the specific legacies made in my codicils. Given under my hand and seal this 12th day of March 1829. [Sig.] Richd. I Richard Sandidge of county of Louisa do make and ordain the following a third codicil to my will (which is in the possession of Edmd. Pendleton) It is my wish that my executors heretofore named in my will) retain one thousand dollars of the money arising from the sales of property which I will directed to be sold in their hands for the benefit of the two children of my nephew, Ralph S. Sandidge, dec’d., and Betsy, his wife. The said children to receive the interest annually till they arrive at the age of twenty one years or marry in either of which events my executors to pay five hundred dollars to each child and in case of death the surviving child to receive the other’s portion together with it’s own. It is my desire that the provisions made in my former codicils be carried into effect and that my will also be carried into complete effect except so far as precented by my different codicils. Witness my hand and seal this 20th day of March 1829. [Sig.] Richd. Sandidge. Teste Nelson S. Hines, Griffith C. Dickenson, John Cole.
At a court for Louisa County on Monday 13 April 1829 will and codicils produced in court by Edmund Pendleton one of the executors and proved by witnesses as well as the codicils.
