In the name of God Amen! I John Cheatwood of the County of Bedford and state of Virginia&#13;
being of sound and disposing mind and memory do make and ordain this my last will and&#13;
testament.&#13;
In Primis- it is my will and desire that all my slaves should be manumitted and set at liberty after&#13;
my decease in manner following. Jim, Henry, Edmond, Daniel, Dick, and Powhatan shall after&#13;
my decease be hired out by my executors hereafter named until the real proceeds of this higher&#13;
shall amount to the sum of, seven hundred and fifty dollars. after which I will and direct that the&#13;
said Jim, Henry, Edmond, , Daniel, Dick, and Powhatan be inlagaes emancipated and set at&#13;
liberty by my said executors by my said executors in such manner and form as may be lawful&#13;
and proper. Item 1 I give and bequeath unto my beloved sister Alice Chatmoss the rest and&#13;
residue of my slaves during her natural life and at her death it is my will and desire that the said&#13;
slaves be also inlarges emancipated and set at liberty in like--P.106&#13;
Manner as those other named, and I do hereby direct the executor who may survive to do all such&#13;
acts for affecting this object as maybe necessary and lawful Item-I give and bequeath to my said&#13;
sister Alice and her executor in trust for the purpose of raising the young negroes, the said seven&#13;
hundred fifty dollars before divided to be raised&#13;
Item. I give and bequeath to my niece Evaline Cheatwood two hundred dollars.&#13;
Item. I give and bequeath to my said sister Alice all the rest and residue of the personal property&#13;
of which I may be possessed or to which I may entitled after the payment of all my debts and the&#13;
legacies here in given.&#13;
Item. If I should purchase any lands or real estate before for my decease, I give and bequeath the&#13;
same to my said sister Alice for lifetime and at her decease I desire and do give and bequeath the&#13;
said lands and real estate to my nephew James Freeland Cheatwood and to his _____ forever&#13;
Lastly, I appoint my said sister Alice Cheatwood executrix and my nephew Hiram Cheatwood&#13;
Executor of this my last will and testament, hereby revoking and annulling any and every will&#13;
by me heretofore made and declaring this to be my last will and testament. In testimony whereof&#13;
I have hereunto set my hand and affixed my seal this 22nd day of February 1821.&#13;

At a court held for Bedford County at the Courthhouse the 27th Day of October 28. This last will&#13;
and testament of John Cheatwood was exhibited in court for probate by the Executor and&#13;
&#13;
Executrix therein named which was objected to by John Lumpkin and Phillip Lumpkin for&#13;
reasons appearing to the court, the same was continued, And afterward same. At a Court held for&#13;
said county the 24th day of November 1828, The same now proved as a will of personal estate by&#13;
the oath of Martha A. Markham one of the subscribing witnesses thereto and ordered to be&#13;
recorded and on the motion of Alice Cheatwood the Executrix therein named who made oath and&#13;
gave bond and security according to law. Certificate is granted her for obtaining a probate&#13;
thereof if in due form liberty being reserved the Executor so given in the probate whenever he&#13;
shall think fit and have given the Executor prove the said will to be a will of real estate. –&#13;
Hiram Cheatwood qualified as Executor at October 07 1836 so ord.&#13;

duly admitted probate and is of record in the clerk’s office of the county court of Bedford. And&#13;
whereas the said Alice Cheatwood has since died and rights to their freedom has arrived to said&#13;
slaves. Now this deed witnesseth that I Hiram Cheatwood executor of the said John Cheatwood&#13;
in furtherance of said last will and testament hereby append to the legacy of freedom bequeathed&#13;
to two of the said slaves to wit Spencer and Bird&#13;
