              <text>I Dawson Warren of the County of Surry and State of Virginia do make and ordain this my last will and testament.&#13;
I give to Rebecca Ann Jones fifteen hundred dollars in cash to her and her heirs forever.&#13;
I desire that my servant Lewis and his wife Barbara and their seven children to wit: Lucy, Ann, Jim, Pocahontas, Solomon, Anaky, Elizabeth, and Lewis should have their freedom if they wish it and should so decide after having time fully to consult and think about it, and if they should so determine ( I mean that Lewis and Barbara shall decide for their children) I give to Jeremiah Delk eight hundred dollars in cash in lieu of Lucy Ann and Solomon who he now owns, and I give him also three hundred and fifty dollars for his right in Barbara and her three youngest children. I also offer to my servant Isham his freedom, and to each of said negroes preferring their emancipation, I give one hundred dollars to enable them to go to some free state or to Liberia. If after having full time to consider the subject and consult disinterested persons, they should prefer to remain as they are, I give to them my sister’s children unless they should desire to choose their own masters, which privilege I wish them to have, and in that case I give to said children the proceeds of their sale.&#13;
I give to Peter, Tempy, Amelia Ann, Virginia and Rufus each ten dollars, and should desire such of them as belong to me to have their freedom also if they could do any thing for themselves.&#13;
My land and five hundred dollars I give to my sister.&#13;
I give to Joseph Holloway one hundred dollars, and to Eliza Carlson and her sister Elizabeth each fifty dollars.&#13;
The balance of my estate of every description I give to my sister’s children to be equally divided among them.&#13;
I nominate and appoint Jeremiah Delk my executor.&#13;

This writing purporting the last will and testament of Dawson Warren, deceased, was this day produced in court by Jeremiah Delk the executor therein named, and there being no subscribing witnesses thereto, William P. Underwood, Edwin White, and William M. West were sworn and severally deposed that they are well acquainted with the testators handwriting and verily believe the said writing and the name thereto subscribed together with the several additions thereto, to be wholly written by the testator’s own hand, whereupon the said writing is ordered to be recorded as the true last will and testament of Dawson Warren, deceased. And on the motion of Jeremiah Delk the only executor therein named, who made oath thereto, and together with Watson White and Peyton A.B. Delk his securities (who were sworn as to their sufficiency) entered into and acknowledged a bond in the penal sum of twenty two thousand dollars, conditioned as the law directs. Certificate is granted the said Jeremiah Delk for obtaining a probate of said will in due form.&#13;

Brown of the County of Rappahannock and State of Virginia do hereby make my last will and testament in manner and form as follows: I will and bequeath to my wife Mary A. Brown one negro woman Adelaid and her future increase, all my household &amp; kitchen furniture, except such as is hereinafter disposed of, also one mare Snap and my oldest [?Portorico?] Colt, fifty barrels of corn and one thousand pounds of bork to have and to hold to her the said Mary A. Brown and her heirs and assigns forever. I further will and bequeath to the said Mary A. Brown the following slaves namely Furlong, Edmund and Russel to have and to hold the said slaves Furlong, Edmund and Russel upon the conditions hereinafter expressed, for and during her natural life or widowhood, that the said slaves shall be hired yearly by my said wife and the money so raised shall be used for the maintenance and support of my said wife and for the maintenance and support and education of my sons John W. Brown and Virginius B. Brown also the sum of two thousand dollars which sum of two thousand dollars is to be for the use and benefit of my said wife and my said sons John W. and Virginius B. as herein directed, the said sum of five thousand dollars shall be loaned upon interest as vested in the purchase of land as shall be deemed most advisable by my executors and the interest and profits there from arising to be received by my said wife for and during her natural life or widowhood and to be used by my said wife for her support and maintenance and the support, maintenance and education of the said John W. and Virginius B. and when the death or marriage of the said Mary A. Brown then and in that case the aforesaid slaves Furlong, Edmund and Russel and the sum aforesaid of two thousand dollars or if land shall have been purchased, with the same the said slaves money or land as the case may be shall be equally divided between the said John W. and Virginius B. and should either of them the said John W. or Virginius B. die before arriving to the age of twenty one years then and in that case the survivor shall succeed to and take the whole legacy to the same slaves money or land herein bequeathed to the said John W. &amp; Virginius B. and should both them the said John W. and Virginius B. die before they shall arrive to the age of twenty one years then and in that case the whole legacy herein bequeathed to the said John W. and Virginius B. shall pass to and be for the sole use and benefit of my sons Thomas W. Brown, James M. Brown, F.C. Newton Brown, and my daughter William E. Brown share &amp; share alike saving and excepting the right and interest aforesaid of the said Mary A. Brown for and during her natural life or widowhood as aforesaid. I further will and bequeath to the said John W. Brown and Virginius B. Brown to John W. a certain colt which he now claims and a saddle to be worth fifteen dollars and to Virginius B. [?Judy?] colt and a saddle with fifteen dollars.&#13;
Item 2nd I will and bequeath to my son Thomas W. Brown the following slaves namely one negro woman Milly and her child and one negro boy Thornton to have and to hold to him the said Thomas W. his heirs or assigns forever. &#13;
Item 3rd I will and bequeath to my son James M. Brown the following slaves William, Howard, Eliza and her child, to have and to hold to him the said James M. his heirs and assigns forever, upon this lot the said James M. is to pay to my estate the sum of eighty seven dollars and fifty cents. &#13;
Item 4th I will and bequeath to my son F.C. Newton Brown the following slaves Harry, Ann, Sarah, Carraline, Catherine, and Lewis also one feather bed, stead and furniture, to have and to hold to him his heirs or assigns forever this lot to receive from my estate twelve dollars and fifty cents. I further will and bequeath to my son F.C. Newton Brown the sum of four hundred dollars which sum he is to have the use of without paying interest, that when my son John W. shall arrive to the age of eighteen years, then the said F.C. Newton Brown shall pay to the said John W. Brown the sum of two hundred dollars, and whom my son Virginius B. Brown shall arrive to the age of eighteen years then the said F.C. Newton Brown shall pay to him the said Virginius B. Brown the sum of two hundred dollars.&#13;
Item 5th I will and bequeath to my daughter Willie E. Brown the following slaves namely Stephen, Mary, Susan, Oscar and Henry one of my best feather beds, stead and furniture, one set silver spoons, lettered W.S.B. and such other items of property in my dwelling house as she the said Willie E. may claim as her own, also one young mare (the colt of a mare called Adda) to have and to hold, to her the said Willie E. her heirs and assigns forever and that the said Willie E. pay to my estate the sum of thirty seven dollars and fifty cents.&#13;
Item 6th I further will and bequeath to the care and protection of my son F.C. Newton Brown my old servant Tom and at such time as the said Tom shall wish to leave the state, then the said F.C. Newton Brown shall deliver to the said Tom freedom papers emancipating, setting free and discharging him the said Thom from labor.&#13;
Item 7th I will and direct that there shall be no charges made for or against my children for advancements made by me heretofore neither shall any of my children be held accountable for or made pay or account for any money they may be owing me by bond, note or otherwise which is not named in this will.&#13;
I direct that F.C. Newton Brown do retain in his possession a certain negro boy by the name Thornton and hire the said boy Thornton &amp; appropriate such hires to the payment of certain debts for which the said F.C. N. Brown is bound as the security of Thomas W. Brown to whom the said boy Thornton is herein devised. &#13;
I direct that all my property not herein devised be sold on a credit of nine months bearing interest from the day of sale and from the proceeds of such sale my executors will first pay all my just debts and funeral expenses, then the legacies herein specified, the overplus if any to be equally divided between my wife and children, share and share alike.&#13;
I do hereby appoint my wife Mary A. Brown Executrix and my son F.C. Newton Brown executor of this my last will and testament hereby revoking all former wills and testaments by me made publishing and declaring this to be my last will and testament. I do hereby direct and request that the court taking probate of this my last will and testament will permit my wife Mary A. Brown and my son F.C. Newton Brown to execute a bond joint of severally as Executrix &amp; Executor of this my last will and testament without giving any security.               <text>In the name of God, Amen. I James Twyman of the County of Madison and State of Virginia being of sound and disposing mind and memory, but calling to mind the uncertainty of life, do make and ordain this my last will and testament in manner and form as follow to wit:&#13;
First, I hereby emancipate and set free all my slaves (except the invalid slaves Noah, Winney and Joe, for whole support provision will be made hereinafter) to wit: Jenny, and Frances Ann, daughter of said Amanda, Simon and Violet his wife and their two sons Abraham and Ambrose, Walker and Charlotte his wife Barbara, Horace and Susan, Short John and Mariah his wife, Nancy, Julia, Jane, Beck, Henry, Elizabeth, Mary Ann, Ellen, Lucy Ann, Pertillo, Eleanor, Charles, James, William, Lewis, Bob, Washington, Lawrence, Albert and Yellow John, and all others not herein named if any, together with all their future increase, whether born before or after my death, as it is my will and desire that all the slaves of whom I may die possessed, shall be free, except the invalid slaves hereinbefore named Noah, Winney and Joe, and for them to be free if they desire it: and it is my anxious desire that the county court of this county shall permit the said negro women Jenny, her daughter Amanda and grand daughter Frances Ann to remain in the county of Madison during their good behavior.&#13;
Secondly. I give and devise to my nephews Isaac S. and James W. Twyman and my friend Lewis B. Williams the survivors and survivor of them and his heirs that part of the tract of land on which I now reside lying and being in the county of Madison supposed to contain two hundred acres and bounded as follows, beginning on Fry’s road at the mouth of Doggins Road corner with Travis J. Twyman, formerly a corner to Alexander Waugh as will be seen by reference to the deed from Waugh to me and running thence with said Doggins Road to my gate on said road, opposite the land of Edward Lightfoot, thence running a straight line, through my farm five hundred and fifty three hands more or less to a locust standing in my meadow twenty five yards North east from the chimney of Simon &amp; Violet’s house, marked as a corner of the purpose, thence from said locust to a gum tree standing on the south side of the road, leading from my stable to my great run farm, two hundred and fifty eight yards, be the same more or less thence continuing the same course across my meadow, below my blacksmith’s shop, five hundred and twenty yards more or less, to a branch leading from the spring, used by my overseer, thence crossing said branch and continuing the same course one hundred and twenty yards more or less, to two white oak saplings, standing on a hill marked as a corner for the purpose thence running a straight line nine hundred and thirty yards more or less to a cherry tree, standing on the east side of Fry’s road a few steps from my gate on said road, known as the school house gate thence with said road to the beginning, to hold the said land in trust for the use and benefit of the said negro women Jenny, Amanda and Frances Ann or such of them as may be living at the time of my death during their join lives, and the life of the survivors and survivor of them, after the death of the survivor of them, to be divided equally between the children of the said Jenny, Amanda and Frances Ann, and the descendants of such children as may be dead in fee simple, said descendants taking the share which their deceased parent would have taken if living, but if the said Jenny, Amanda, and Frances Ann should all die without leaving child or children or descendants of such child or children, at the time of the death of the longest liver of them, then it is my will and desire, that the said Isaac S. Twyman, James W. Twyman and Lewis B. Williams or either of them, the survivors or survivor of them, his heirs, exors, or adm’s shall sell the said tract of land, and pay one half of the net proceeds arising from said sale to the President and Directors of the Literary Fund for the use of the County of Madison, the interest of which is to be annually applied by the said President and Directors to the education of the poor children of the County of Madison, as the School quotas of said county from said fund are now applied, or at the Legislature from time to time, shall direct, and the other half thereof to the parties entitled under this my last will and testament to the residuum of my estate, they taking the same in the same manner and in the same proportions as the residuum of my estate is hereinafter directed to be divided amongst them. If the said Henny, Amanda and Frances Ann, the survivors or survivor of them or either of them, are refused permission to remain in the County of Madison during their good behavior, and are thereby forced to leave the Commonwealth of Virginia, or they all, or the survivors or survivor of them shall desire to remove, and shall voluntarily remove therefrom, into any of the free states of this Union, then the said Isaac S. Twyman, James W. Twyman, and Lewis B. Willams, the survivors or survivor of them, his heirs, exors or adrs, shall sell the said tract of land, and invest the proceeds of such sale in a suitable and comfortable home for said Jenny, Amanda and Frances Ann, the survivors and survivor of them in such state as they may desire to be held in the same manner and under the same limitations and to pass and go as the said tract of land hereby devised is to pass and go, if the same should not be sold but the said land hereby devised is devised with the limitation and restriction that my invalid slaves Noah, Winney and Joe are to be permitted to use and occupy the houses in which they now live during their lives, or as long as they may remain in the state, and to have a sufficient quantity of fire wood reserved for their use on my other lands convenient to them, a reservation of the houses to be made in the event of the sale of the said two hundred acres of land.&#13;
Thirdly. I give and bequeath to the said Isaac S. Twyman, James W. Twyman and Lewis B. Williams the survivors and survivor of them, his heirs, ex’rs and adm’rs the sum of eighteen thousand dollars to be invested by them or either of them, the survivors or survivor of them, his exo’rs or adm’rs in state or other permanent stocks, the whole interest of which after deducting all proper costs and charges is annually to be applied to the support, maintenance and comfort of the said Jenny, Amanda, and Frances Ann, or such of them as may be living at my death, the survivors and survivor of them, during their lives, and after the death of the longest liver of them to be divided between the children of the said Jenny, Amanda, and Frances Ann, and the descendants of such as may be dead, such descendants taking the share which their parent would have been entitled to, if living, the said stock to be transformed to them at the time of such division and to be held by them in fee simple – But if the said Jenny, Amanda, and Frances Ann shall all depart this life, without leaving child or children at the time of the death of the longest liver of them, or during my lifetime, then and in that event, I give the said money or stock, if they money is so invested as follows to wit: eight thousand dollars thereof to the President and Directors of the Literary Fund to be held by them, the interest to be applied to the education of the poor children of the County of Madison as the school quotas of said county from said fund are now applied, or as the legislature may from time to time direct, and the remaining ten thousand dollars to the parties who shall be entitled under this my last will and testament to the residuum of my estate, they taking the same in the same manner and in the same proportions as the residuum of my estate is hereinafter directed to be divided amongst them. &#13;
Fourthly. I give and bequeath to the said Jenny, Amanda, and Frances Ann or such of them as may be living at my death for their joint benefit, to the survivors and survivor of them and the heirs of such survivor, all my silver plate, my clock and watch, my household furniture of every description, two good horses, four good milk cows, all my fowls of every kind, and plentiful supply of provisions of every description to support them for one year after my death, and all the hay, straw, and long food which may be and remain on the land devised to them in trust, for their use and benefit, the year of my death.&#13;
Fifthly. I give and bequeath to the said Amanda eight hundred dollars to her and her heirs forever, and I give and bequeath to the said Frances Ann and her heirs the like sum of eight hundred dollars.&#13;
Sixthly. I hereby give and bequeath to my nephew Robert D. Twyman and his heirs the sum of one thousand dollars. &#13;
Seventhly. It is my will and desire that my ex’ors hereinafter named shall place out upon good and satisfactory security the sum of three thousand dollars to be held by them, and with the interest thereof take care of, support and maintain in a suitable manner my invalid negroes Joe, Noah, and Winney and it is my will and desire that if either of said negroes Joe, Noah, or Winney should desire their freedom and to leave the State, that he or they should be set free, and I hereby emancipate and set free all or either of them who may desire it, and out of the said sum of three hundred dollars, I hereby direct my said ex’ors to apply at least five hundred dollars for the removal and location of each of them in one of the free states of this Union, and should they all desire their freedom and to leave the state with my other slaves herein before set free, then it is my will and desire that fifteen hundred dollars be added to the sum hereinafter provided for the removal of my slaves other than Jenny, Amanda and Frances Ann and their location in one of the free states of this Union from the said three thousand dollars and the said slaves Joe, Winney, and Noah to share equally in the provision made for them.&#13;
8thly. I give and bequeath to the said Isaac S. Twyman, James W. Twyman, and Lewis B. Williams and their heirs the sum of one thousand dollars each in consideration of my confidence that they will faithfully execute the trusts hereinbefore confided to them in preserving the money and land devised to them for the benefit of my negro women Jenny, Amanda, and Frances Ann the survivors of them and their children if they should have any, in protecting the rights of said women, investing said money in stocks, land or other property, changing the said investments when necessary, receiving the interest on said stocks, appropriating the same and watching over their interests, whilst they remain in this Commonwealth, which said sum of money and all other money legacies are to be due and payable within twelve months after my death and to bear interest from the expiration of said twelve months.&#13;
9thly. I hereby give and bequeath to my ex’ors hereinafter named the sum of ten thousand dollars to be applied by them to the removal of my slaves hereby emancipated (except Jenny, Amanda and Frances Ann for whom provision has already been made herein) to one of the free States of this Union, and their location therein, or elsewhere, if they should desire it, and to the purchase of a home or homes for them, together with provisions and clothing for one year for them, and all necessary tools to work the land on which they may be located. &#13;
10thly. It is my will and desire that my said ex’ors lay out the sum of two hundred dollars in the purchase of a home for Betsy Loyd and her single daughters, during the life of said Betsy Loyd, and after her death for the benefit of said daughters, as long as they may remain single, and after the marriage or death of all them I give the same to the said daughters and the descendants of such as may be dead, the said descendants taking the shares of their parents, and in the even of the death of all, then to their heirs in the same manner.&#13;
11thly. It is my will and desire that all my lands not hereinbefore disposed of be sold by my ex’ors hereinafter named upon such terms and conditions as they may think conducive to the interest of my estate and that the proceeds thereof in their hands be subject to the payment of all my just debts legacies &amp;c. And it is my will and desire that my slaves Jenny, Amanda and Frances Ann be free from the time of my death and that they should have the use of the land devised in trust for their benefit: the horses, cows, household furniture, clock, watch, silver plate, hay, straw, and other long food devised to them from that time.&#13;
12thly. I give and bequeath to the President and Directors of the Literary Fund the sum of two thousand dollars to be applied to the education of the poor children of the county of Madison as the school quotas of said county from said fund are applied, that is to say, that the principal sum shall be invested for that purpose, and the annual interest thereof is applied by the said President and Directors, unless the Legislature shall think it conducive to the interest of the said poor children to use a part of the principal thereof in which even a portion thereof may be so applied.&#13;
13thly. I hereby charge all the aforesaid devises of money upon my whole estate real and personal and mixed all to have priority over the bequest to the President and Directors of the said Literary Fund as made in the clause immediately preceding this, in their payment, and no abatement to be made thereof, the land devised in trust for Jenny, Amanda and Frances Ann, and the personal estate bequeathed to them being exempted from all liability to pay legacies; and after the payment of all legacies, I give and devise all the rest and residue of my estate (the personal estate to be sold by my ex’ors) except what is herein before disposed of, after the payment of all my just debts, funeral expenses and costs of administration thereto, to the children of my brother Anthony Twyman, my sister Nancy Willis, the children of my deceased sister Francis Hill dec’d and the children of my deceased brother William Twyman. My brother Anthony’s children to have one fifth part, my sister Nancy Willis to have one fifth part; the children of my late brother Reuben Twyman to have one fifth part; the children of my deceased sister Frances Hill to have one fifth part, and the children of my deceased brother William Twyman to have the remaining fifth part. I have not included my brother Travis J. Twyman as one of the beneficiaries in this clause of my last will and testament simply because he has no children and is very independent, and not from any want of affection and regard for him, holding him now as, as I have ever regarded him, as a brother entitled to the same affection and consideration as my other brothers, and entitled to a like provisions, if he had children or needed my assistance. &#13;
Lastly, I hereby constitute and I appoint my brother Anthony Twyman and my nephew William H. Twyman son of said Anthony executors of this my last will and testament written on two sheets of paper, both signed with my name, hereby revoking all other wills heretofore made by me. Slaughter, David Hume, and Reuben Garnett, hereby confirming said last will and testament, except so far as the same is altered or explained by this codicil that is to say.&#13;

First. I hereby revoke the legacy of two thousand dollars to the President and Directors of the Literary Fund, as set forth in the 12th clause of my said last will and testament, the annual interest of which was to be applied to the education of the poor children of the County of Madison, as the school quotas from said fund are applied &amp;c, and it is my will and desire that the said sum of two thousand dollars be added to the residuum of my estate and be distributed as the residuum is directed to be in my said last will and testament and amongst the same persons and in the same proportions.&#13;

Secondly. I hereby revoke so much of the second and third clauses of my said last will and testament, as gives one half of the proceeds of the sale of the land devised in the said clause to Isaac S. Twyman, James W. Twyman and Lewis B. Williams the survivors and survivor of them and his heirs in trust for the women Jenny, Amanda, and Frances Ann the survivors and survivor of them &amp;c or the land which may be purchased with the said proceeds of sale, in the event of the said Jenny, Amanda and Frances Ann dying without leaving child or descendant at the time of the death of the longest liver of them and the sum of eight thousand dollars out of the sum of eighteen thousand dollars devised to the said Isaac S. Twyman, James W. Twyman and Lewis B. Williams the survivors and survivor of them, his heirs, ex’ors and adm’rs in trust to invest the same in state or other permanent stocks, the whole interest to be applied annually to the support, comfort and maintenance of the said Jenny, Amanda, and Frances Ann, the survivors and survivor of them, upon the even of their dying without child or descendant living at the death of the longest liver of them, to the President and Directors of the Literary Fund, the interest to be applied to the education of the poor children of the County of Madison as the school quotas from said fund for said county are applied, and it is my will and desire that in the event of the contingency happening upon which the said President and Directors of the Literary Fund were taken one half of the proceeds of the sale of said land, and the said sum of eight thousand dollars shall be added to and become a part of the residuum of my estate spoken of in my said last will and testament, and be divided between the same parties, and in the same proportions, as the residuum of my estate is directed to be distributed amongst them.&#13;

Twyman for the benefit of Amanda, Jenny and Frances Ann by said clauses of my said last will and testament hereby annulling his powers as such and I hereby revoke the legacy given in the eighth clause of my said last will and testament of one thousand dollars to the said Isaac S. Twyman, James W. Twyman and Lewis B. Williams each, and I hereby revoke the legacy of one thousand dollars given to my nephew Robert D. Twyman in the sixth clause of my said last will and testament. And I hereby devise the said real estate and money named in the said second and third clauses of my said last will and testament that is the two hundred acres of land on which my buildings are as described in the said second clause of my said last will and testament and the eighteen thousand dollars devised in the said third clause of my said last will and testament, to my nephews Robert D. Twyman, Isaac S. Twyman and James W. Twyman the survivors and survivor of them, his heirs, ex’ors and adm’rs to be held by them the survivors and survivor of them his heirs, ex’ors and adm’rs upon the same trusts and limitations, and for the same uses and purposes to be applied in the same manner, and to descend in the same way in which the said land and money are directed to pass and go by my said last will and testament, as directed in the sand 2nd and 3rd clauses of my said last will and testament as altered and modified by the codicil thereto of the 13th of September 1848.&#13;
&#13;
2ndly. I give and bequeath to the said Robert D. Twyman, Isaac S. Twyman and James W. Twyman and their heirs the sum of two thousand dollars each in consideration of my confidence that they will faithfully execute the trusts herein before confided to them in preserving the land and money devised to them in my said last will and testament as altered by this codicil thereto for the benefit of Jenny, Amanda, and Frances Ann, the survivors and survivor of them and their children, if they should have any in protecting the rights of said women, investing said money in stocks, land and other property, changing the said investments when necessary, receiving the interest on said stocks, appropriating the same and watching over their interest whilst they remain in this Commonwealth which said sums of money and all other legacies are to be due and payable within twelve months after my death and to bear interest from the expiration of twelve months after that event. &#13;

Twyman, Isaac S. Twyman, and James W. Twyman, the survivors and survivor of them, and the heirs of such survivor the land devised by the 2nd clause of my said last will and testament to Isaac S. Twyman, James W. Twyman, and Lewis B. Williams the survivors and survivor of them and his heirs for the benefit and comfort of said Jenny, Amanda and Frances Ann, the survivors and survivor of them and for other purposes as set forth therein and altered and modified by the said first codicil to my said last will and testament, and whereas doubts may arise whether the execution of said deed of emancipation and deed to Robert D., Isaac S. and James W. Twyman is or is not a revocation of the clause of emancipation in whole or in part, as well of the clauses thereof devising or giving land money and other property to the said Jenny, Amanda and Frances Ann or to trustees for their benefit and for other purposes or a satisfaction thereof in whole or part, now to obviate all difficulty in relation thereto, and to explain my meaning and declare my intention by the said last will and testament and first codicil thereto, the said deed of emancipation and deed conveying said land to Robert D. Twyman, Isaac S. Twyman, and James W. Twyman the survivors and survivor of them and his heirs, I hereby declare that it is my will and desire that the said Jenny, Amanda, and Frances Ann, the survivors and survivor of them and their children and descendants whether free under the operation of said deed or my said last will and testament shall have the full benefit of all the provisions of my said last will and testament as fully and as effectually as if the same provisions were again made in and by this codicil for them as free persons heretofore emancipated, to be held by the same trustees the survivors and survivor of them his heirs, ex’ors and adm’ors who are designated in the second and third clauses of my said last will and testament, to wit: Isaac S. Twyman, James W. Twyman, and Lewis B. Twyman upon the same trusts and limitations and the same conditions as are set forth in my said last will and testament and first codicil thereto to be held, invested and applied and to pass and go in the same manner as far as I have power to control the same.&#13;
2ndly It is my will and desire that the said Isaac S. Twyman, James H. Twyman, and Lewis B. Williams the survivors and survivor of them his heirs, ex’ors and administrators be the trustees to receive the sum of eighteen thousand dollars devised by the third clause of my said last will and testament to them for the purposes therein named and to prevent any misconstruction of my will and desire, I hereby again devise the said sum of eighteen thousand dollars to them, the survivors and survivor of them his heirs, ex’ors and admors for the benefit of the said Jenny, Amanda, and Frances Ann the survivors and survivor of them and their children and descendants of such as may be dead at the death of the survivor of said Jenny, Amanda, and Frances Ann to be invested by said trustees as therein directed, and to pass and go to the parties therein directed as modified by the said first codicil to my said last will and testament, upon the contingencies therein set forth, and that the said Isaac S. Twyman, James W. Twyman and Lewis B. Williams and their heirs is to have the money devised to them in the eighth clause of my said last will and testament at the time directed to be paid to them for the purposes therein set forth.&#13;

At a court held for Madison county the 22nd day of March 1849. On this day Lewis B. Williams brought into court and delivered to the clerk under a sealed envelope, which was opened by the clerk under a sealed envelope, which was opened by the clerk, four papers which marked A.B.C.&amp;D.  The first maker (A) bearing date the first day of August 1848, purporting to be the last will and testament of James Twyman deceased. The 2nd marked (B) bearing date the 13th day of September 1848. The third marked (C) bearing date the 15th day of September 1848. And the fourth marked (D) bearing date the 9th day of November 1848, and purporting to be codicils to the said last will and testament. Whereupon William H. Twyman one of the Executors named in the said last will and testament propounded for probate as testamentary papers, containing together the true last will of said James Twyman the papers marked (A) B. &amp; C. and the women Jenny, Amanda, &amp; Frances Ann named in the said papers, containing together the true last will of the said James Twyman the papers marked A.B.&amp; D. And thereupon Trais J. Twyman a brother of the said James Twyman and Thomas Hill Jr and Edwin Hill nephews of the said James Twyman, entered themselves as parties contesting and opposed the probate of all or any of the said papers. Whereupon by consent of parties the case is continued until the first day of the term of this court to be holden in the month of May next. And on motion of the said Travis J. Twyman the court doth appoint him Curator of the personal estate of the said James Twyman during the contest about the said last will and testament, whereupon he entered into bond in the penalty of one hundred thousand dollars, with John Terrill, William A. Hill, Nathaniel J. Welch, John S. Walker, Alfred J. Twyman, John P. Aylor, Thomas Hill Jr., Merry Aylor, Edwin F. Hill, and Thomas Spararks as his securities.&#13;

At a court held for said County the 24th day of May 1849. The papers produced at March court last and marked A.B.C.&amp;D. and purporting to be the last will and testament and codicils thereto of James Twyman deceased, was again offered for probate by the same parties propounding and in the same manner as at the term aforesaid. And thereupon Travis J. Twyman, Thomas Hill Jr. and Edwin Hill, the persons who then entered themselves as parties contesting, were thrice solemnly called but came not; whereupon the paper marked (A) was proved by the oaths of Tho. T. Slaughter, David Hume, and Reuben Garnett witnesses thereto and ordered to be recorded. And the paper marked (B) was proved by the oaths of Tho. T. Slaughter and John H. Lee witnesses thereto and ordered to be recorded. And the paper marked (C) was proved by the oaths of Tho. T. Slaughter, Jno. H. Lee, and Reuben Garnett witnesses thereto and ordered to be recorded. And the paper marked D. was proved by the oaths of John H. Lee and Tho. T. Slaughter witnesses thereto and ordered to be recorded. And on the motion of Anthony Twyman and William H. Twyman Executors named by said James Twyman, a certificate for obtaining a probate of said papers in due form is granted them and thereupon they qualified according to law and entered into bond in the penalty of one hundred and fifty thousand dollars, with William A. Hill, James W. Twyman, Merry Aylor, Robert D. Twyman, William Early, Isaac S. Twyman, Hiran Yager, John Terrill and Elliot Blankenbeker as their securities.&#13;

              <text>In the name of God Amen. I Peter Stephens of the County of Carroll and State of Virginia do ordain this my last will and testament hereby revoking all other wills whatsoever. I give and bequeath to John Early my negro woman Edalina and her children and Susan and her children to take care of as it is my wish that they shall have their freedom. I also give and bequeath my boy David also to John Early. I give and bequeath to my brother James Stephens my boy George and [?Mon?]. I give my boy Rubin to my brother Joseph Stephens’ widow. I give and bequeath my Pierce Sam to John Early. I give and bequeath all my land in the County of Carroll to John Early by he paying to Margaret Seaton twelve hundred dollars at two installments, one half in eighteen months and the other half in three years. I wish all of my personal property to be sold and my debts paid and if there should not be a sufficiency to pay, then I wish some of my land sold that is in Wythe County and the balance I will and bequeath to my brother Joseph Stephens’ widow, all claims existing between John Early are to be considered settled. I wish my hands to remain as they are until fall and then I desire a sale of all my personal property. I desire John Early to control my hands and attend to the making of the crop. I wish my brother James and John Early to act as my executors, whereof I have set my hand and seal.&#13;

This writing purporting to be the last will and testament of Peter Stephens dec’d bearing date on the 20th day of May 1849 was produced in court by John Early and James Stephens, the Executors named in the said writing, in order to be proved and Samuel Coffee and Rebecca his wife and William Dobbins and Elizabeth his wife, which said Rebecca Coffee &amp; Elizabeth Dobbins are sisters and heirs at law of the said Peter Stephens dec’d appeared and opposed the proof of the said will: whereupon divers witnesses were sworn and examined, and the parties aforesaid fully heard by their counsel: on consideration whereof it was the opinion of the court that the said Peter Stephens deceased at the time of executing the writing aforesaid dated the 20th day of May 1849 was of sound and disposing mind and memory and that he was under no undue influence. And Daniel B. Sanders, Andrew J. Hardy and Henry Hardy, the subscribing witnesses to the said writing having testified in court that the said Peter Stephens signed and published the same in their presence, as and for his last will and testament that they subscribed their names as witnesses thereto in the presence of the said Testator and at his request and that the said Testator was of sound mind and memory as far as they know or believe; it was ordered that the said writing of the 20th day of May 1849 be recorded as the last will and testament of the said Peter Stephens deceased.               <text>I Robt C. Nicholas of the County of Dinwiddie do this 26th day of February 1846, in my own hand writing make ordain and constitute this to be my will and testament for the disposal of all my estate of every description after my death. &#13;
In the first place, I give to my wife Ann the plantation on which I now reside during her life or widowhood and at her death or marriage, to her and my children now seven in number, to them and their heirs forever.&#13;
In the second place, I give to one of my slaves by name Kezia that I traded with my father for her freedom.&#13;
3rd I give to Mary the daughter of Kezia her freedom.&#13;
4th All the rest and residue of my estate as well real as personal that I may die possessed of, or, that may in any way hereafter become a part of my estate, I give to be equally divided, amongst or between my aforesaid wife and my seven children namely John, Robert, Horatio, George, Harriet, Gray and Ann my wife’s part or portion, during her life or widowhood only, and at her death or marriage to my children above named &amp; their heirs forever.&#13;
Altho’ I have said above that I wish my property after my death divided among my family, that is to say my wife and children, I should greatly prefer that they hold it in common for the use of all, and that my wife and my two eldest sons have the power to dispose of any part of the property, real or personal (with their joint concurrence) that they may think will ultimately tend to the benefit of the family in general.&#13;
If it shall become necessary that some person qualify as executor or administrator on my estate, I hereby nominate my friends David May and John P. Crump Esq. Executors to this my last will and testament – one of whom I hope will act, at any rate, till one of my sons become of age, to who the administration as executor can then be transferred – in which case, it is my wish that he may not be held to give security. &#13;

At a court held for Dinwiddie County on the 16th day of October 1848. This writing, purporting to be the last will and testament of Robert C. Nicholas deceased, was produced in court, and there being no subscribing witness thereto, Nathaniel Wilson and Alexander Donnan were sworn and severally deposed that they are well acquainted with the testator’s hand writing, and verily believe the said writing and the name thereto subscribed, to be wholly written by the testator’s own hand thereupon, the said writing is ordered to be recorded as the true last will and testament of the said Robert C. Nicholas deceased – David May and John P. Crump Executors named in said will renounced their right to qualify as such which is ordered to be entered of record. At another court held for the said county on the19th day of March 1849. On the motion of John P. Nicholas who made oath, and entered into and acknowledged a bond in the penalty of twenty thousand dollars, conditioned as the law directs, certificate is granted him for obtaining letters of administration on the said decedents estate, with his will aforesaid annexed in due form.&#13;

First, I recommend my soul to God who gave it trusting to a glorious immortality through the merits and righteousness of my Lord and Savior Jesus Christ; Second, I desire after my decease that I be buried in a decent and Christian manner, and as regards my slaves to wit: Maria, Patience, Amelia, William, Henry Blanch, Priscilla, Harriett, Peggy, James, Mary, and their future increase they are to remain in the possession of my husband Jn Deaton during his natural life time and for his benefit &amp; use, they my slaves are to be hired out for a term of years until their hire shall pay a debt due the estate of Jn Foster deceased, amounting to five hundred dollars more or less after the payment of the aforesaid $500 due the estate of Jno Foster dec’d they my slaves are to be hired out for a term of years to raise the sum of six hundred &amp; fifty dollars which sum I will and devise as follows to wit: I give &amp; bequeath Francis A Deaton, Hardyman Deaton, Polly Goodwin, Hester Day, Eliza Horn &amp; Sally Temple and their heirs forever the sum of one hundred dollars each to be raised as aforesaid by the hire of my slaves as aforementioned; I give and bequeath to my sister Sophia Hubbard the sum of fifty dollars to her &amp; her heirs forever; it is my will and desire after the payment of the above named debt of $500, and the legacies aforesaid of $650, shall have been fully paid off and liquidated from the hire of my slaves they are to have the privilege of removing to a free state and settling there and in the event of their accepting their freedom, they are to be hired and long enough to raise funds to transport them to a free state and give them some meant to make a beginning on and in the event of their declining to accept their freedom &amp; remove to a free state.
