<text>Dear Green June 9th 1836
Confiding implicitly in your honor as a man it is needless to call on your affection as a brother to carry in effect my ultimate wishes. My course of life forced on me from circumstances I do not with to estimate, but so long as I live it is my wish to act honorable to the world and to carry with me to the grave a conscience devoid of crime in its own conviction however it may be judged of by others. First. I wish you to provide for the children Virginia and Ann, I wish them to have five hundred dollars each and to divide equally Joanna and her increase. Chenan and her children should she have any must have their freedom. Should she prefer living here give her a hundred acres of land, and the whole of my medical accounts and if you do not give her this place, build a comfortable house for her. The balance of my estate is yours and your heirs. Should Chenan prefer moving to Ohio give her an equivalent to what is mentioned above. Green to you I have entrusted duties more dear to me than existence, I feel that I shall not be deceived. God only knows when my life may be ended and I may not have the time to do that which is here allotted to you but come when death may this sketch imperfect as it is will plainly inform you of any intention. Fulfill to the uttermost my brother, what I here request and may God bless you and yours.
Mr. Green Hill Richard Hill

At a court held for Dinwiddie County on the 15th day of January 1844.
This writing purporting to be the last will and testament of Richard Hill dec’d was presented in court by Green Hill, and there being no subscribing witness thereto, Isham E Hargrave & Hartwell H. Lewis were sworn and severally deposed that they are well acquainted with the testator’s hand writing, and verily believe the said writing and the name thereto subscribed and the superscription thereon endorsed to be wholly written by the testator. Whereupon, it is ordered that the said writing be recorded as the true last will and testament of the said Richard Hill dec’d. And on the motion of Green Hill, who took oath prescribed by law, and together with Isham E. Hargrave George W. Rose and David F. Hoy his securities entered into and acknowledged a bond in the penalty of thirty thousand dollars conditioned as the law directs, certificate is granted him for obtaining letters of administration on the estate of Richard Hill dec’d with his will annexed in due form.

That part my estate which may fall to my son John S Green upon a division I give in trust to my son Jones Green to be held by him during the natural life of the said John S. the profits whereof to be applied to the use and benefit of the said John S and his family, but not to be subject to or in any manner liable for any debts or debts of any kind due by or which may be contracted by the said John S. and upon the death of the said John S. the same is to be divided amongst his heirs agreeable to the law of descents. That part of my estate which may fall to my daughter Frances Parsons I give in trust to my son Charles Green to be held by him during the natural life of my said daughter Frances, the profits whereof to be applied to her use and benefit, but not to be subject to the payment of any debts or debts due by her husband George M Parsons or any debt which he may contract, but to be held for the sole use and benefit of my said daughter & upon the death of my said daughter the said part is to pass to her daughter Elizabeth Brent if living and if not then to the children of the said Elizabeth Brent. In the settlement and division of my estate, I direct that no interest be charged upon obligations or notes held by me from my sons or sons in law except a note which I hold which was given by my son James Green for two hundred dollars and which was assigned to me. I earnestly advise my beloved wife to make a compromise with her children for her interest in my estate by having a specific sum placed at interest on ample security the interest to be paid half yearly, believing as I do that if she takes her third she will find the management of it very troublesome & unpleasant.
I direct that as speedy a settlement be made of my estate as practicable after my decease, by division of the same, and a division of all bonds, notes & accounts which may be due me and lastly I constitute and appoint my son in law William A.
Whereas I James Green of the County of Rappahannock (formerly Culpeper) have made my last will & testament in writing bearing date the 20th day of January 1833 and have since annexed several codicils thereto, but yet desire to make my meaning upon some points more clear & explicit than it is in them, now therefore I do hereby declare this present writing to be a further codicil to my said will and direct the same to be annexed thereto and taken as a part thereof.
In the first place, as to any bonds or other claims which at the time of my death I may hold upon my son John S. Green & any property real or personal belonging to me which shall be at that time in his possession as well as the distributive share of my estate, which would otherwise be his under the fourth clause of this codicil, all of this I give & bequeath to my son Jones Green in trust, for the benefit of the family of the said John S Green in such manner & form as is expressed in my said will.

Secondly, as to any bonds, or other claims which at the time of my death I may hold upon my son in law George M Parsons or my daughter Frances Parsons, and any property real or personal belonging to me which shall be at that time in his or her possession, as well as the distribution share of my estate which would otherwise come to him or her under the fourth clause of this codicil – all this I give & bequeath to my son Charles Green, in trust, for the benefit of the said Frances Parsons & her family in such manner & form as is expressed in my said will.

Thirdly, as to any bonds, or other claims which at the time of my death I may hold upon any of my children, other than those mentioned before & any property real or personal belonging to me which at that time shall be in the possession of such children or any of them – I give & bequeath the same to such children respectively upon whom I may hold such bond or other claims, or in whose possession such property may be.
Fourthly, It is my will & desire that the rest and residue of my estate of all kinds be divided in like manner as if I had died intestate, but with this understanding however that in making such division there shall be no hotchpot account taken of any advancements heretofore made by one, or which may be hereafter made by me to any of my said children or their descendants.

Fifthly – Having become the suety of my daughter Dorothea F. Ashby in a bond to John G Lane acting as her trustee in the sum of three thousand one hundred & sixty two 96/100 dollars, dated the 27th September 1842, I direct (if said bond shall not have been paid by her) my executor to discharge & pay it off out of her share of my estate which will come into his hands.
And lastly, I do ratify & confirm my said will & the codicils heretofore annexed to it, except so far only as the same shall be inconsistent with any thing contained in this present codicil.
In testimony whereof I hereunto set my hand 7 affixed my seal this 18th day of February 1843.

In the event of the death of my great grand daughter Elizabeth Lane Scott, before she attains the age of twenty one, then & in that case I give & bequeath the above legacy of four hundred dollars, intended to be given her, to my grandson John G Lane, in trust, for the sole use & benefit of my grand daughter M Frances Scott & heirs.

Item 2nd I wish my gold watch that I wear to be sold, as my other property is directed to be sold, and the money to be put out on interest as my other monies are directed in my will.
Item 3rd My silver watch I give to Oliver P. Bendall.
Item 4th and lastly, I constitute and appoint John Y. Mason of the County of Southampton and Isham E. Hargrave of Dinwiddie County my lawful executors to my last will and testament and to this codicil, revoking all other persons. And I wish them to take charge of my estate as soon as convenient after my death, and further wish for them to be as liberal to my sisters as they can be allowed as executors.
Given under my hand and seal this 24th day of May 1842.

A second codicil to my will…
Upon reflection I think it best to make some alteration. I loan to my sisters Sally May and Martha Oliver the following negroes to wit: namely Lewis, Isabel, Howard and Minerva and her two children namely Roseander and Sally Ann; those negroes are to live on the plantation on which my sisters now resides but not to be subject to be taken for any debt they may now owe, or contract after this time.
At the death either of my sisters the above slaves are to descend to the survivor as long as either shall live, and at the death of both, then the above slaves are to be sold and the money put as directed in my will.
I emancipate and set free the following slaves to wit: Mary and all of her children, namely Mary, Jack, William, Alexander, Jim, Richard and Lucy and all that she the said negro woman may have after this time.
I direct my executor to sell all the balance of my slaves and appropriate the money arising from the sale of said slaves as directed in my will.
I also wish exors to have my new house which is now being built, finished (called ? Hill) rented or leased together with the land in the west of the road, and attached thereto; and the proceeds paid out annually to my sisters Sally May and Martha Oliver.
I also wish and direct my executor to have my grave dug on the north side and near my mothers and walled in, in like manner with brick, and covered over with a marble slab. As witness my hand and seal this 21st December in the year of Lord one thousand eight hundred and forty three.

Dear Sir:
I am as low as I can be, and should I die I want you to have my will and two codicils proved. I wish you to take charge of my whole estate, and lot of to my wife what she is entitled to; under the law and the will. I have loaned to my sisters six negroes. I have set Mary and all her children free, the balance of negroes that come by me, I wish all sold, and the money arising for the sale, I wish put at interest as my will directs other monies to be put at interest. Oh Judge please comply with my request. There is no one that I am willing to leave my affairs with but you. I leave you my only executor. Farewell, Judge, Farewell.

In Chesterfield County Court February 12th 1844
The last will and testament of Thomas A. Oliver deceased was proved by the oaths of John Britton and Edwin James, witnesses thereto, and is ordered to be recorded; together with two codicils to said will were produced and there being no subscribing witnesses to the same, John Britton, Edwin James, and E.A. Shands being sworn severally deposed that they are well acquainted with the handwriting of the said deceased and verily believe the said codicils and the names thereto subscribed to be wholly written by the testators own hand, whereupon the same were ordered to be recorded as codicils to the last will and testament of said Thomas A. Oliver deceased. And at a court held for said county the 11th day of March following, another codicil to the said will was produced in court and proved by the oaths of Daniel H. Burge and William H. Brown witnesses thereto and ordered to be recorded.
On the motion of John F. May executor in one of the said codicils named who made oath and entered into bond with security conditioned, as the law directs, a certificate is granted him for obtaining probate in due form of law.
