<text>In the name of God. I Richard Smith of the County of Amherst in the State of Virginia being at this time in feeble health but of disposing mind and memory and desirous of giving direction after my death to the Estate it has pleased providence to bless me with do hereby will and ordain the following as my last will and testament intending to revoke all others by me heretofore made.
In the first place. It is my will and desire that my Executors hereafter named do and of my Estate pay and satisfy all my just debts and for that purpose I charge my whole Estate but in the order hereinafter mentioned.
Secondly. It is my desire that on the happening of my death or as soon after as the crop on hand shall be finished my Executors shall proceed to sell all my perishable Estate except my Slaves and that they also sell my lands, which is a Tract lying in the County of Amherst whereon I at this time reside the terms of sale in every case where a sale is directed to be left to the discretion of my Executors who will be guided therein, as such sale as shall best and in the most ready way effectuate the whole purpose of my will.
Thirdly. I calculate that the proceeds of the sales of my perishable Estate other than of my Slaves will be more than sufficient to satisfy and pay my funeral expenses and just debts, and should it so exceed them then I direct that my Executors shall heed such residuum subject to the will and purposes herein after set forth. But should it not be sufficient I direct that so much of the proceeds of the sale of my lands may be applied until said funeral expenses and just debts are fully paid.
Fourthly. It is my will and desire that my slaves Leanty a woman about forty five years of age. Mary her daughter and Henry her son he and they are hereby manumitted them and the increase of the females which may after any time of the date hereof be born unto them.
Fifthly. I give to my said Slaves hereby intended to be manumitted that is Leanty, Mary and Henry in equal portions any residue arising from the sales of my perishable Estate first deducting there from as herein before provided my funeral expenses and just debts, and I also give to the same persons and in the same proportions five hundred dollars out of the proceeds of the sale of my lands to them and to their heirs forever.
Sixthly. It being suggested by my legal advisor, that Slaves manumitted like the foregoing are forbidden by the Laws of the Commonwealth to remain therein beyond the term of seven months this being the case It is my desire that my Executors do apply to the Legislature by petition on behalf of the said Slaves praying that an act may pass allowing them to reside within this State. If upon application to the proper tribunal leave cannot be obtained for the said Slaves to be manumitted as aforesaid to remain in the State, then it will be a subject left to the judgment and discretion or rather choice of the said Leanty, Mary and Henry to remove themselves without the limits of the Commonwealth to such place or places as they may be enabled to enjoy their freedom or to remain within it and they and their posterity to be the slaves of some person or persons. If they decide upon removal then I decide that my Executors shall appropriate to their use the pecuniary legacies herein before given to the purposes of such removal and the settlement of themselves in the Country they may emigrate to and in the selection of which I desire that my Executors may aid them by their advice and better rights on the subject. If on the contrary leave cannot be obtained for their remaining within the State and they prefer to remain here and be Slaves then it is my will and desire that the said Leanty, Mary and Henry be left at liberty freely to choose from amongst my blood relations their Master or Masters Mistress or Mistresses as they and each of them shall see fit and the person or persons so selected to heed them or him as his or her property together with the share of the pecuniary Legacies to which he she or they of the said persons Leanty, Mary or Henry according to the foregoing provisions may be entitled without charge therefore. In this latter case altho [sic] I cannot impose any legal condition upon the title and ownership which will accrue to the selected relation or relations yet I will make the request that each relation or relations will not only treat them humanely but show them all the favor allowed by the Laws of the Land, the usages of our Society, and as far as may be appropriate the money which may go with them to their extraordinary comforts and convenience.
Seventhly. Should there be any surplus arising from the Sales of my Lands after satisfying the foregoing purposes of my will, I desire that it be paid over by my Executors to my friends Dudley Sandridge, Dabney Sandridge, James Powell, and Charles Tucker in equal portions which I give to them respectively and their heirs forever.
Eighthly. I give to my nephew Jacob Smith son of John & Sarah Smith the three following Slaves that is to say: Neely, Kelly, and John to him and his heirs forever.
Ninthly. I give to my nephew Richard Smith Jr. son to William and Philadelphia Smith the seven following Slaves that is to say: Harry, Peter, Simon, Ann, Leanty (the younger), Caroline, and Davy to him and his heirs forever. But my said nephew Richard is to take the said seven slaves charged with the sum of one thousand dollars to be paid by him to my nephew Richard B Smith son to John and Sarah Smith to be paid by the said Richard to the said Richard in ten annual equal installments from the date of my death.
Tenthly. I give to my nephew the said Richard B Smith the said one thousand dollars charged upon the legacy of my said nephew Richard Smith Jr to be paid him to therein provided to him and his heirs forever.
I do lastly hereby appoint my nephews Richard smith Jr and Richard B Smith both aforesaid the Executors of this my last will and testament. In testimony of all which I have hereunto signed my name sealed with my seal and dated this 5th day of April 1836.
