              <text>This indenture made this 9th day of May one thousand eight hundred and three between James Hackley &amp; Elizabeth his wife of the County Nelson and State of Kentucky of the one part and Philip Slaughter and Robert Patton of the State of Virginia of the other part. Witnesseth that the said James Hackley and Elizabeth his wife for and in consideration of the full &amp; just sum of one thousand dollars to them in hand paid by the said Philip Slaughter &amp; Robert Patton the receipt whereof they the said James Hackley and Elizabeth his wife we hereby acknowledge have given, granted, bargained and sold and by these presents do give, grant, bargain and sell unto the said Philip Slaughter &amp; Robert Patton their heirs and assigus forever all the right, title, interest, claim and demand which they the said James Hackley &amp; Elizabeth his wife have in and to a certain tract or parcel of land lying &amp; being in the county of Culpeper &amp; State of Virginia adjoining the lands of William Gray, Leonard Barnes, Moses Samuel, Joshua Woodrow &amp; Philip Slaughter (formerly Jacob Pickerings land and whereon Capt William Ball formerly lived which tract of land was the property of John Hackley deceased who bequeathed the same by his last will &amp; testament bearing date the sixteenth of March one thousand seven hundred &amp; ninety nine and duly proved and recorded in the county court of Culpeper State of Virginia reference thereto being had will more fully appear in the following words). I give and bequeath to my friend Gen’l James Williams of Orange County to him and his heirs forever the tract of land whereon my Uncle William Ball now lives together with the following negroes viz. to which will was annexed a writing in the following words: memo for my exor Gen’l James Williams my will is that my Uncle &amp; Aunt Barrow keep the negroes they now have viz. Jude and her children during their lives and then for the said negroes to be set free except my Uncle Ball be living and then it is my desire that they be given up to him during his life all the rest of the property willed to you. I desire that you will let me uncle keep possession of and have the use &amp; benefit thereof subject nevertheless to your control so far as to prevent waste &amp; during his life, if my Uncle or Aunt Barrow be living when my Uncle Ball dies it is my desire that you let them keep as much of the land as you may judge necessary to their maintenance during their lives &amp; the balance to be given up to my brother James Hackley &amp; to cut the matter short it is my desire that at the death of my Uncle Ball and Barrow and my Aunt Barrow that my brother James Hackley shall have the land they live on which will and writing was admitted to record in the county court of Culpeper and State of Virginia the fifteenth day of June eighteen hundred and one in the following words. This last will &amp; testament of John Hackley deceased was exhibited to court by James Williams the exor therein named and was proved by the oaths of Mordicai Barbour, John Thom and James Allen three of the witnesses and a writing being also presented by the said Exor directing him what to do with his estate was proved to be wholly in the hand writing of the Testator by the oaths of Mordicai Barbour &amp; John McCoul both of which are ordered to be recorded, which said tract or parcel of land bequeathed as aforesaid contains four hundred &amp; eighty acres more or less and bounded as follows beginning at a box oak &amp; pine corner to Col. William Gray then with his line south ten degrees west to hundred &amp; four poles near two pine bushes in the field thence south seventy degrees east one hundred &amp; sixty seven poles to a box oak corner to Gray (now down) thence north eleven degrees east fifty one poles to Grays and Barnes corner thence with Barnes corner thence with Barnes the same course continued three hundred &amp; seventeen poles making in all three hundred and sixty eight poles to a white oak on the south side of the main county road leading from Stevensburg to Fredericksburg corner to Mr. Robert Slaughter thence up the said road the several courses thereof with Slaughter’s line to a white oak on the south side of said road corner to said Slaughter &amp; Moses Samuel thence with the said Samuel’s line south eleven degrees west fifty two poles to a box oak and two white oaks corner to said Samuel &amp; to Philip Slaughter (formerly Jacob Pickering’s land) then with Slaughter’s line the same course continued one hundred and fifty poles to Slaughter’s corner in William Gray’s line then with the said Gray’s line to the beginning together with all and singular the appurtenances thereunto belonging unto the said Philip Slaughter &amp; Robert Patton their heirs and assigus forever &amp; the remained and remainders, rents, issues, and property thereof &amp; of every part &amp; parcel thereof to have an to hold all the right, title, interest, claim &amp; demand of in and to the said tract of land of them the said James Hackley &amp; Elizabeth his wife &amp; all persons claiming under them &amp; the said James Hackley &amp; Elizabeth his wife shall and will warrant and forever defend all their right &amp; title in and to the aforesaid tract of land unto the said Philip Slaughter and Robert Patton and their heirs forever and the James Hackley &amp; Elizabeth his wife do hereby covenant &amp; agree to and with the said Philip Slaughter and Robert Patton they will at any time at the reasonable request &amp; proper costs &amp; charges of then the said Philip Slaughter &amp; Robert Patton make, do and execute or cause to be made done &amp; executed  my further or other deed or deeds which may be advised necessary for the more full &amp; perfect conveying of all their right, title, and interest in and to the aforesaid tract of land unto the said Philip Slaughter &amp; Robert Patton &amp; their heirs forever but it is been fully understood &amp; acknowledged by both contracting parties that in case the aforesaid tract of land should be lost or taken by a better or prior claim or claims than that of the said James Hackley &amp; Elizabeth his wife that they will not be answerable nor any ways accountable nor neither are they bound to return the purchase money.
